Guest Use Agreement & Comprehensive Liability Waiver Applies to All Guests, All Amenities, and All Property Conditions Includes Community Pool, Hot Tub, Beach Access & Environmental Risks By booking this property, you and all members of your party acknowledge and accept the following terms. This agreement is binding upon all guests associated with the reservation. 1. COMMUNITY POOL & HOT TUB – USE AT YOUR OWN RISK The pool and hot tub are community amenities maintained by the property’s homeowners association (HOA). They are unsupervised and used entirely at your own risk. All guests must comply with posted HOA rules including hours, maximum occupancy, safety policies, and behavior standards. Temporary closures may occur without refund due to weather, maintenance, or public health guidance. 2. WATERBORNE ILLNESS & LEGIONNAIRES’ DISEASE NOTICE Legionella bacteria, which can cause Legionnaires’ disease (a potentially serious form of pneumonia), may exist in water systems, including but not limited to: Pools or hot tubs Showers, faucets, sinks Cooling systems or HVAC units Sprinklers, decorative fountains, or other plumbing fixtures While the host and HOA adhere to industry-standard maintenance practices, no system is guaranteed to be free of Legionella or other waterborne pathogens. By staying at this property and using any water system, you acknowledge and accept: The inherent risk of exposure to Legionella and other environmental bacteria That guests who are immunocompromised, elderly, smokers, or have chronic respiratory or kidney conditions may be at higher risk That you voluntarily assume all risks related to such exposure and waive liability to the maximum extent permitted by Maryland law 3. GENERAL SAFETY RULES – POOL, HOT TUB & BEACH No lifeguard is on duty. Children must be supervised at all times. No diving, running, or glass containers allowed near the pool or hot tub. Use of alcohol or drugs while using these amenities is prohibited. Limit hot tub use to 15 minutes. Consult a doctor before using the hot tub if pregnant, elderly, or suffering from heart, blood pressure, or respiratory conditions. 4. BEACH ACCESS & OCEAN HAZARD NOTICE The property provides access to a public or semi-private beach. There are no lifeguards. Swim at your own risk. Ocean hazards include: Riptides and strong currents (which can be fatal even for strong swimmers) Sharks, jellyfish, and other marine wildlife Floating debris, rough surf, and changing weather conditions Guests are responsible for supervising minors and ensuring safe behavior at the beach. Do not swim alone, and avoid swimming at dawn/dusk or after storms. 5. PROPERTY CONDITIONS & ENVIRONMENTAL RISKS The property may include stairs, walkways, decks, uneven terrain, insects, wildlife, and other natural features. Guests should use caution outdoors, especially at night or after rainfall. The host is not responsible for injury or illness related to natural hazards, allergic reactions, slips, or animal encounters. 6. RELEASE OF LIABILITY & INDEMNIFICATION To the maximum extent permitted by Maryland law, you and your guests agree to: Waive, release, and discharge the host, property owner, manager, and affiliates from any and all liability or claims for: Injury, illness (including Legionnaires’ disease), or death Property damage or loss Emotional distress Exposure to natural, biological, or environmental hazards This includes incidents arising from: Use of the pool, hot tub, or beach Water or HVAC systems on or near the property Acts of nature, third parties, or HOA-controlled spaces This waiver covers ordinary negligence but not gross negligence or intentional misconduct, which cannot be waived under Maryland law. You further agree to indemnify and hold harmless the host for any damages, legal claims, or expenses arising from your own or your guests’ misuse of the property, failure to follow rules, or violation of community policies. 7. ACKNOWLEDGMENT By booking this property, you confirm that: You are 18 or older and legally authorized to accept these terms for your entire party. You have read and understood this agreement in full. Effortless beach week. So grateful NOT to have to deal with toxic air-fresheners, dirty dishes, light pollution, poorly chosen furniture, buying supplies, funny smells, crappy blinds, clutter... This condo is superior to many other AirBNB we have rented. Absolutely NOTHING was worrisome. Plumbing in tip-top shape, gorgeous bedding. Kitchen very well stocked (we actually cook most of our meals.) Detergent provided and plentiful. Not a speck of dirt or grime anywhere. This level of excellence is rare. The view is tremendous, and beach access is easy. Parking, elevator, luggage carts - all easy. The price is quite high, but we decided it's worth the attention to detail that is given to this property. We already booked for next year, and hopefully by then the building renovations will be complete. Highly recommend this quiet, spacious, extremely private unit at Marigot. Thanks Elysian.

Host was very responsive and accommodated all of our requests. The building itself is outdated and a bit rundown however the apartment is modern and beautifully updated. Beds and lines were top notch. The view from the master bedroom and balcony was worth a million dollar. Would definitely stay here again.

We had an absolutely wonderful stay at this incredible Ocean City condo! The host went above and beyond to make our visit special—surprising our daughter with Birthday Princess decorations for her 8th birthday, which made her day unforgettable. The views of the ocean are breathtaking, with huge picture windows that let in plenty of natural light and provided stunning sunrise views. The beds were exceptionally comfortable, ensuring we were well-rested every night. The showers were luxurious, and the high-end finishes throughout the condo added an extra touch of elegance. The kitchen was a dream—beautifully designed, spacious, and equipped with everything we needed. Every detail in this condo was thoughtfully planned, making it both stylish and welcoming. Overall, it’s a perfect getaway spot. We would give it a 10/10 and can’t wait to return! Highly recommend it to anyone looking for a fantastic stay in Ocean City!
